Ember and Oak Mobile Cigar Lounge - Terms of Service

Welcome to Ember and Oak Mobile Cigar Lounge! We are dedicated to providing a premium and memorable experience for your special event. To ensure a smooth and enjoyable occasion, please carefully review the following terms and conditions.

1. Services and Rates

  • 1.1 Standard Rate (Local):

    • Our standard rate begins at $449, with final pricing dependent on your selected package and specific event requirements.

    • Customized services, special requests, and travel beyond our standard service area may incur additional fees. These will be clearly communicated and agreed upon prior to booking.

  • 1.2 Additional Hours:

    • Extended service beyond the originally booked time is available at a rate of $100 per hour.

    • Requests for additional hours must be made at least 30 minutes before the scheduled end time and are subject to availability.

  • 1.3 Holiday Rate:

    • Events scheduled on recognized holidays will incur an additional $150 per hour surcharge, applied to the standard hourly rate or package cost.

  • 1.4 Extended Events:

    • For day-long or multi-day events, please contact us directly for a customized quote tailored to your specific needs.

2. Deposit and Payment

  • 2.1 Booking Deposit:

    • A non-refundable deposit is required to secure your booking. The deposit amount will be specified at the time of booking and will be applied towards the final balance.

  • 2.2 Final Payment:

    • The remaining balance is due seven (7) business days prior to the event date.

    • Failure to provide full payment by this deadline may result in cancellation of services.

  • 2.3 Payment Methods:

    • We accept payments via cash, major credit cards, and electronic transfer.

    • Any returned payments will result in added fees.

3. Event Requirements and Policies

  • 3.1 Age Verification:

    • All guests and participants must be 21 years of age or older.

    • Valid government-issued identification may be required for entry into the lounge.

  • 3.2 Venue and Access:

    • The client is responsible for ensuring suitable venue access, including parking and setup space, as communicated and agreed upon with Ember and Oak.

    • Clients must obtain any necessary venue permissions or permits.

    • It is the clients responsibility to inform Ember and Oak of any venue restrictions.

  • 3.3 Gratuity:

    • Gratuity for our staff is appreciated but not required.

    • Clients may include gratuity in the final payment or provide it directly to our staff at the event.

  • 3.4 Liability:

    • Ember and Oak is not responsible for any damage to the venue that is caused by guests.

    • The client is responsible for any damage caused by the clients guests.

  • 3.5 Conduct:

    • Ember and Oak reserves the right to stop services if the conduct of the clients guests are deemed unsafe, or inappropriate.

4. Cancellation and Rescheduling

  • 4.1 Cancellation:

    • All booking deposits are non-refundable.

    • Cancellations made within seven (7) business days of the event date will result in forfeiture of the full payment.

    • Cancellations made with more than seven (7) business days' notice will allow the paid fees, minus the non refundable deposit, to be credited toward a future booking within the same calendar year, subject to availability.

  • 4.2 Rescheduling:

    • Rescheduling is subject to availability. Rescheduling must be requested by the client no less than 7 days prior to the event.

5. Weather and Force Majeure

  • 5.1 Weather:

    • For outdoor events, we will make reasonable efforts to accommodate inclement weather, including adjusting setup or offering rescheduling options.

    • Rescheduling due to weather is subject to availability.

  • 5.2 Force Majeure:

    • Neither party shall be liable for any failure or delay in performance under this agreement due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, or government regulations.  

6. Miscellaneous

  • 6.1 Amendments:

    • Ember and Oak reserves the right to amend these terms and conditions at any time. Any changes will be communicated to the client in writing.  

  • 6.2 Governing Law:

    • This agreement shall be governed by and construed in accordance with the laws of the state in which Ember and Oak operates.
